The recent history in the United Kingdom, Australia and elsewhere of detention centres and control orders for such individuals demonstrates the paucity of the principle of non-refoulement when stripped to its essentials. In addition, in the landmark case of Othman (Abu Qatada) v. United Kingdom [2012] Application 8139/09, the European Court of Human Rights held that returning someone to a state with a history of torture would not necessarily violate the principle of non-refoulement where a so-called Memorandum of Understanding (MOU) was in place between the asylum state and the state of origin. These MOUs are supposed to guarantee humane treatment of the deportee, although they are highly controversial, with questions often raised as to how effective they are in preventing torture and other forms of serious maltreatment.
